The management attribute is the basic attribute of the university constitution.Since teachers and students are always under the strong control mode of the university,their rights are easily eroded.Therefore,the important issue to be considered in the formulation of the university charter is how to reduce the improper influence on teachers and students and protect their rights and interests when the school is implementing the administrative management,so as to realize the coordination of efficient management and the development of teachers and students.The principle of proportionality is a rule in administrative law that restricts public power from interfering with private rights.The constitution of a university has the characteristics of administrative legislation.Therefore,the principle of proportionality can be used throughout the constitution-making process of a university to achieve the balance of interests of all parties.
