考试作弊犯罪最新司法解释的针对性检视：基于实证分析的反思

Reexamination of the Application of Law in Handling Criminal Cases Regarding Cheating in Examinations Based on an Empirical Analysis

2019年9月3日,最高人民法院和最高人民检察院联合发布《关于办理组织考试作弊等刑事案件适用法律若干问题的解释》,针对考试作弊犯罪的具体适用作出细化规定。通过对《刑法修正案(九)》增设此类犯罪后相关司法适用的实证分析发现,最新司法解释与司法适用中存在的实际问题之间,依然存在若干无法全然对应之处。因此,只有通过进一步完善考试作弊犯罪刑罚适用标准,增强相关司法解释的针对性,才能更为有效地打击考试作弊犯罪,真正实现增设此类罪名的立法目的。

In order to counter against examination cheating more effectively,on the basis of adding new crimes in The 9th Amendment to the Criminal Law,the Supreme People’s Court and the Supreme People’s Procuratorate issued the latest interpretation of the criminal law in 2019,and made detailed provisions on the application of law in handling criminal cases regarding organized examination cheating.However,through the empirical analysis of the judicial application after the adopting of such crimes,it is found that there are still some problems between the latest judicial interpretation issued by the Supreme People’s Court and the Supreme People’s Procuratorate and the judicial application,which not only challenges the pertinence of the judicial interpretation,but also raises some challenges for the relevant parties,including legislators,judicial researchers and even legal researchers.
