摘要
2019年9月3日,最高人民法院和最高人民检察院联合发布《关于办理组织考试作弊等刑事案件适用法律若干问题的解释》,该司法解释对“法律规定的国家考试”的范围界定合理,针对考试作弊犯罪的应对措施有法律依据,且具有可行性;但该解释对一些基本概念的界定仍然缺失,对有关犯罪的具体情节和犯罪既遂标准的规定也存在不足。
On September 3,2019,the Supreme People’s Court and the Supreme People’s Procuratorate jointly promulgated the Interpretation on Several Issues Concerning the Application of Law in the Trial of Criminal Cases Involving Organizing Cheating in Examinations.It is reasonable about the scope of the national examination prescribed provided by law in the judicial interpretation.The countermeasures against the crime of cheating in the examinations stipulated by the judicial interpretation have legal basis and feasibility.But,meanwhile,the judicial interpretation still lacks some basic definitions,and there are still some insufficiencies about the circumstances of the crime and the standard of accomplished offence.
