因工死亡职工供养亲属享受抚恤金待遇的资格和标准,由社会保险经办机构核定。随着国家"全面二孩"政策和全民参保政策的执行,"放管服"改革的深入推进,因工死亡职工供养亲属享受抚恤金待遇的资格确认和标准核定存在较多难点,如因工死亡职工的父母是退休人员,领取基本养老金,其配偶是农村居民,享受城乡居民养老保险待遇,那么,其配偶是否符合享受供养亲属抚恤金范围?是不论其父母的养老金额度高低,均视为仅保障职工本人退休后的基本生活,而对其配偶领取的城乡居民养老金进行补差,还是将其父母的养老金与当地的生活水平、工亡职工的家庭情况进行综合研判,再确定其配偶是否符合享受供养亲属抚恤金范围?再如,工亡职工的父母有两个子女提供生活来源,其供养亲属抚恤金是向父母中的一人提供,还是为其父母二人都提供,等等。这些难点实际上为工伤保险提出了一项要求,即随着形势的变化,应适时修订和完善供养亲属抚恤金的相关政策。

For example, if the parents of the deceased workers have two children to provide a source of livelihood, then whether the pension is provided to one of their parents or both, and so on. These difficulties actually put forward a requirement for work-related injury insurance, that is, with the change of the situation, it is necessary to timely revise and improve the relevant policies for providing pension for the dependent relatives of workers who died at work.
