The Dilemma in the Practice of Local Legislation and Its Solutions

地方殳法应当围绕依法行政管理和解决地方实际问题运转,重点解决公众反映强愈的民生问题等。作为立法草案的供给方,行政管理部门的管制思维越强,民生权益的保护面临的风险越大。分析地方立法的实践困境,提出殳法实践中,需通过更新殳法理念、规范地方殳法运行机制、加强立法草案审查、强化地方立法能力建设等措施提升地方立法水平,完善法治建设。

Local legislation should focus on law-oriented administration and the solution to local practical problems,in particular the solution to people's livelihood problems strongly reflected by the public.As the supplier of the draft legislation,the stronger the regulatory thinking of the administrative department,the greater the risk faced by the protection of people's livelihood rights and interests.This paper analyses the dilemma in the practice of local legislation.Meanwhile,it presents some measures to improve the level of local legislation and to perfect the construction of rule of law,such as updating the legislative concept,improving the legislative system,standardizing the operational mechanism of local legislation,strengthening the review of draft legislation,the construction of legislative team and the construction of local legislative capacity,etc.
