摘要
生态文明建设是和谐社会的重要组成部分,人民检察院是构建生态环境法律保护的重要力量。本文以深圳地区46起生态环境犯罪典型案例为蓝本,考察深圳生态环境犯罪的整体样态,反映出深圳生态环境犯罪司法治理中存在重惩罚轻恢复、认罪认罚从宽推行效果有限以及信息共享、联动机制效果有限的问题。针对此,检察机关需勇立潮头、有所作为。可尝试探索建立先行示范区生态修复机制作为认罪认罚从宽的重要考量标准;探索重构检察机关程序分流机制以应对"案多人少"的司法困境;探索完善污染环境信息共享机制,实现生态环境信息在行政、公安、检察机关之间无缝流转和共享。
The construction of ecological civilization is an important part of a harmonious society and the People’s Procuratorate serves as an important force for the legal protection of ecological environment.Based on 46 typical cases of eco-environmental crime in Shenzhen,this paper examines the overall pattern of eco-environmental crime in Shenzhen,reflecting the problems of heavy punishment and light recovery,limited effect of lenient admission of guilt and punishment and limited effect of information sharing and linkage mechanism.In response to these problems,the People’s Procuratorate need to take the courage and make a difference by establishing the ecological restoration mechanism of the pilot demonstration area as an important consideration standard for the lenient admission of guilt and punishment,exploring the reconstruction of the procedure diversion mechanism of procuratorial organs to deal with the judicial dilemma of“many cases but few people”,and improving the mechanism of information sharing on pollution environment to realize the seamless circulation and sharing of ecological environment information among administrative,public security and procuratorial organs.
