政治合法性是对价值正义性的一种承认,同时构成了对公共机构及其权力行为正当性的评价标准。中国共产党在西方话语意义上使用合法性概念审视自身执政行为,彰显了高度的自信。对执政党主体地位和自身条件合法性的考察,是党领导法治建设合法性分析的前置性工作;而通过将"合法性指数"概念和权利-义务分析框架引入并运用于对中国共产党领导法治建设行为的合法性评价,则为系统深入地阐释中共执政行为的政治价值指向提供了科学标准和科学模式,为执政党领导中国法治建设注入了反思性向度,这是助力执政党及其领导的法治建设事业进一步走向更大成功的重要理论拓展。

Political legitimacy is a kind of recognition of value justice, and also constitutes the evaluation standard for the legitimacy of public institutions and their power behaviors. The Chinese Communist Party develops the concept of legitimacy in the western discourse to examine her own ruling behavior, which shows a high degree of confidence. The self-investigation of legitimacy of the ruling party’s subjective position and conditions is a preliminary work for the analysis of legitimacy of the Party’s leadership of the construction of the rule of law. The concepts as "legitimacy index " and the"right-duty analysis framework"introduced and applied to evaluate the Chinese Communist Party’s behavior of the leadership of the construction of the rule of law, provide the scientific standard and pattern for in-depth interpretation of the political value system of the Party’s ruling behavior,as well as the reflective direction. That’s the important theory expansion which could help our Party and the construction of rule of law directed by her to greater success.
