Basic Methods of Judicial Identification of “Evil Forces”——Take the gangster-related cases in the city F of the southeast coast F province in the special campaign of “crime crackdown” as a sample

对"恶势力"犯罪及其认定的研究,当前仍处于发展期,相关规范性文件虽陆续出台,但规定尚不完善,处于不成熟阶段,实践中出现了"定恶"难,黑恶难以区分的困境。目前,"恶势力"的独立认定标准,已经出现了"三、三、二"标准和"四特征"说,内、外部特征相对明显。随着"扫黑除恶"专项斗争的推进,"恶势力"被赋予了新时代下的新内涵,因此,构建出具体可行的"恶势力"司法认定模型,细化"恶势力"与黑社会性质组织的内在边界,具有较强的现实意义。将"恶势力"全面纳入量刑规范化建设的改革思路,以统一量刑尺度为目标,能够解决当前,乃至今后涉及"恶势力"的一系列犯罪案件的量刑不规范的难题。

The research on the crimes of"evil forces"and its identification is still in the development stage.Although the relevant normative documents have been issued,the regulations are still incomplete.There are difficulties in"determining evil"and distinguish evil and gangster in practice.At present,the independent identification standards for"evil forces"have emerged as "three,three,two"standards and"four characteristics", with relatively obvious internal and external characteristics.With the advancing of the special campaign of "anti-crime and antievil","evil forces"have been given new connotations in the new era.Therefore,it has a strong practical significance to build a concrete and feasible model of"evil forces"judicial identification and refine the inner boundary between it and the underworld society.Incorporating"evil forces" into the reform thinking of the sentencing standardized construction and unifying sentencing standards,can solve a series of criminal cases of non-standard sentencing involving evil forces.
