法律移植与知识产权刑事保护制度本土化

On the Localization of the Criminal Protection System of Intellectual Property Rights from the Perspective of Legal Transplantation

知识产权刑事保护法律移植并没有带来预想的治理效果,本土因素的阻碍力量不容忽视。从制度变迁角度来看,知识产权刑事保护本土化的主要阻碍并非来自规范本身,其实质则是本土经济、政治和社会环境对于超前移植法律的排异现象。知识产权刑事保护制度的本土化,改造本土资源是关键。刑事制裁并非越强越好,只有与其他调整手段保持内在协调,才能发挥自身的强效用。囿于资源的稀缺性,知识产权刑事保护中的司法“主导”,不应过多强调数量化,而应当更多地强调示范性。

The transplantation of Criminal Protection Law of Intellectual Property has not brought about the desired governance effect,and the hindrance of local factors cannot be ignored.From the perspective of institutional change,the main hindrance to its localization does not come from the norms themselves,but from the exclusion of local economic,political and social environment for the advanced transplantation of laws.The key to the localization of its criminal protection system is to transform the local resources.The criminal sanctions are not the stronger the better when keeping internal coordination with other adjustment means.Only by keeping internal coordination with other means of adjustment can criminal sanctions exert their own severe effects.Due to the scarcity of resources,the judicial“leading”in the criminal protection of intellectual property rights should not put too much emphasis on quantification,but more on demonstration.
