摘要 保护作品完整权之有损作者声誉构成要件已具有《著作权法》上的实然地位,否定该构成要件存在的非声誉论忽视法条解释的立法历史解释法和目的解释法值得商榷。根据著作权基本理论以及国外高水平精神权利立法动态,判断是否侵犯保护作品完整权也应当以有损作者的声誉作为客观构成要件。 Prejudicing author’s or authors’ reputation has already been an integral constitutive requirement for the right to integrity in the Chinese Copyright Law. The arguments denying its existence are open to discussion for neglecting the legal interpretative methods of legislative history and legislative purposes. According to the basic theories of copyright as well as the dynamics of high-level moral rights legislation abroad, assessing whether an act infringes the right to integrity should also use prejudicing author’ or authors’ reputation as an objective requirement.
