在新时代的司法实践中,把社会主义核心价值观融入法律论证,既是对中国传统法治思想的继承和超越,又是马克思主义法哲学的内在要求,更是社会主义核心价值观融入法治建设的应有之义和关键环节。社会主义核心价值观融入法律论证的过程必须坚持法治原则、合理性原则、开放性原则、价值引领原则、问题导向原则和人民主体原则。究其根本,"融入"具有鲜明的实践品格和时代关怀,它旨在培育和形成全社会的共同精神纽带,进而筑牢中华民族伟大复兴的共同思想基础。

In the process of judicial practice for the new era of socialism with Chinese characteristics, integrating the core socialist values into legal argumentation is a kind of inheritance and transcendence of Chinese traditional thoughts of rule of law, an internal requirement of Marxist philosophy of law, and an important part, even the key part, of integrating the core socialist values into legal process. In the process of integrating core socialist values into legal argumentation, we must adhere to the principle of rule of law, the principle of rationality, the principle of openness, the principle of value guidance, the principle of problem orientation and the principle of people’s subjectivity. Ultimately, "integrating" is of a distinct practical character, and also a reflection of the times, which aims to cultivate and form a common spiritual bond of the whole society, and then build a common ideological foundation for the great rejuvenation of the Chinese nation.
