论社区劳动刑在中国的立法问题

On the legislation of community labor penalty in China

我国司法机关积极主张引入并适用社区劳动措施,从表面看是基于追求个案合理而行动,但从实质看却是探索我国刑罚制度的改革,就我国现行刑罚种类结构上的问题进行纠正。我国应当引入社区劳动刑的原因是:其一,我国现行刑罚体系中存在刑种空缺问题;其二,社区劳动刑具有重要的刑种填空价值。根据社区劳动刑国际立法的经验,特别是我国的刑罚需要,我国应当采取单独规定模式规定社区劳动刑,并对志愿性、公益性、无偿性、时间性等要素予以考量。

China’s judicial organs actively advocate the introduction and use of community labor measures,which is based on the pursuit of a reasonable case and action from the point of view of the phenomenon,but from the point of view of the essence is to explore the reform of China’s penal system,to correct the problem on the types of our current penal structure.Community labor punishment should be introduced into our country.Secondly,community labor penalty has important filling value.According to the experience of the international legislation of community labor penalty,especially the penal needs of China,China should adopt the separate regulation mode to stipulate community labor penalty,and include the elements of voluntariness,public welfare,gratuitous and timeliness.
