The Character of China’s Procedural Rule of Law in the New Era of Socialism with Chinese Characteristics

新时代中国特色社会主义程序法治所涉范围甚广,既有对立法程序、行政程序的关注,也有对诉讼程序的探讨。其中,由基本特点与基本理念共同构成的程序法治的品格是新时代中国特色社会主义程序法治的理论核心。程序法治的品格主要围绕程序法发展的规律性与科学性,探寻新时代中国特色社会主义程序法治更深层次的内涵。新时代中国特色社会主义程序法治的品格主要包括两大层面的内容:其一,基本特点,具体表现为普适性与国情性的统一、静态性与动态性的统一、法律性与政策性的统一以及阶段性与终极性的统一;其二,基本理念,集中体现为程序法治与实体法治并重、以人民为中心、价值平衡。

The studies on theprocedural rule of law in the new era of socialism with Chinese characteristics involves a wide range of issues,covering the legislative procedures,the administrative procedures,and litigation procedures.Among them,the core issues under theorization are the character of procedural rule of law,in particular its basic traits and concepts.The character of procedural rule of law mainly focuses on the regularity and scientific nature of the development of procedural law,and explores the essence ofrule of law in the new era of socialism with Chinese characteristics.The character of procedural rule of law in this period mainly includes the following two aspects:first,its basic traits,which are embodied in the unitiesbetween universality and national conditions,between the static structure and dynamic process,between law and policy,and between the short-term and ultimate goals;second,its basic concepts,which are manifested in putting equal emphasis on the procedural rule of law and the substantive rule of law,taking apeople-oriented principle,and achieving a balance among different typesof values.
