清水江文书所见土地交易过程研究

A Study on the Land Transaction Process in Qingshuijiang Documents

清水江地区存在大量的土地交易契约,为认识地权变动促使清水江地区社会变迁提供了途径。通过梳理民国时期清水江地区土地交易的契约,文章认为清水江地区土地交易中存在立草契→填写官契纸→"推收过割"(拨册除户与立户)→立"领字"→完纳契税→办理土地管业执照的过程。其形成的过程是民间私契行为与国家契约管理互动的产物。

There are a large number of land transaction contracts in Qingshuijiang region, which can provide a better way to understand how the changes of land rights promoted social changes in Qingshuijiang region. By combing contracts of land transaction in Qingshuijiang region during the period of the Republic of China, this paper maintains that the process of land transaction included the process of making a draft contract, filling in official contracts, making changes, writing receipts,paying taxes, and applying for land management license, which was the product of the interaction between folk private behavior and state management.
