摘要
城市化的快速发展吸引大量农民离开居住地向城市迁移,造成宅基地资源的闲置浪费和粗放利用,实现宅基地使用权的合理规范流转成为盘活农村资产、实现乡村振兴的重要内容。宅基地流转必须建立在宅基地产权明晰、物权保障的基础上,实行农村房地一体的不动产对于促进宅基地使用权的流转具有重要意义。因此,选取河南省G县的30位农户为调查对象,采用半结构式访谈法获得农户的“房地一体”不动产登记和宅基地流转的数据,进行归纳分析,发现了房地一体不动产登记视角下宅基地流转存在的一系列问题,如农村“一户多宅”、超面积建房现象严重、房地权属来源材料不齐全等,并根据这些问题提出一系列建议。
The rapid development of urbanization attracts a large number of farmers to move away from their residence to the city,which causes the waste and extensive utilization of the homestead resources.The reasonable and standardized transfer of the right to use the homestead has become an important part of vitalizing the rural assets and realizing the Rural Revitalization.The transfer of homestead must be based on the clear property right and real right guarantee of homestead.It is of great significance to promote the transfer of the right to use homestead by implementing the real estate integrated with rural real estate.Therefore,this author took 30 farmers in G County of Henan Province as the research object,obtained the data of real estate registration and homestead transfer of farmers by semi-structured interview method.Through induction and analysis,the paper found a series of problems,such as"one family with multiple homesteads"in rural areas,phenomenon of building over area,and incomplete source materials of real estate ownership,and put forward a series of suggestions based on them.
