摘要 刑事诉讼法学理论是从现实的司法世界中抽象出来的理论共识与规律,是"外在实践活动"向"内在理性结构"的转化。"治本"教学模式是与传统理论讲授为主的教学模式相对应的范畴,它强调"法律伦理"的植入与"法律思维"的养成,旨在从根本上促进学生对法学知识的深刻体悟与理解,激发其作为"法律学人"乃至"法律人"的使命感与责任感,促使其进行真正有生命力的学习与研讨。"真实卷宗研判""模拟法庭训练"等实践性教学方法的采用,能够有效帮助法科学生摆脱"确证偏见"的束缚、纠正"认知偏差"、养成正确的"法律思维",这对于面向社会、面向司法实务部门培养和输送真正合格的法律人才具有重要意义。 The theory of criminal procedure law is a theoretical consensus and law abstracted from the real judicial world. It is the transformation from "external practice activity" to "intrinsic rational structure". The "rule-based" teaching mode is a category corresponding to the traditional theoretical teaching mode. It emphasizes the implantation of "legal ethics" and the development of "legal thinking", aiming to fundamentally promote students’ profound knowledge of law. Comprehension and understanding can stimulate its sense of mission and responsibility as a "legal scholar" and even a "legal person" and prompt them to conduct truly life-long learning and discussion. The adoption of practical teaching methods such as "real file research" and "simulation court training" can effectively help law students get rid of the "confirmation of prejudice", correct "cognitive bias" and develop correct "legal thinking". It is of great significance to train and deliver truly qualified legal talents to the society and the judicial substantive department.
