韩国第三者侵害配偶权之精神损害赔偿责任研究

The Third Party in Marriage for Spiritual Damage Compensation to the Non-fault Spouse in South Korea

韩国法院认为,第三者与有过错配偶的婚外性行为等不贞行为,属于不法行为,它会对无过错配偶造成严重的精神损害,在第三者故意实施不贞行为导致对方夫妻婚姻关系破裂的情形下,第三者应对无过错配偶一方承担精神损害赔偿责任,该责任为不真正连带责任,且赔偿金额应控制在一定范围内。韩国的司法实践经验,对我国法院处理同类案件,乃至将来在立法上确认该制度,具有借鉴意义。

In the view of the courts in South Korea,the act of infidelity,such as the affair of a third party and a spouse with a fault,is a wrongful act,which will cause serious mental damage to the non-fault spouse.In the case of a breach of the marital relationship of the other party by the intentional act of the third party,the third party shall be liable for moral damage to the non-fault spouse,which is a kind of unreal joint and several liability.The amount of compensation shall be controlled within a certain range.The experience of the judicial practice in South Korea is a reference for our country s courts to deal with the same cases and to confirm this kind of duty in laws in the future.
