当前网络短视频发展迅猛,短视频行业也面临着版权保护的危机。在众多如出一辙的短视频中,如何判断其是否构成侵权就值得我们思考。在认定短视频版权侵权时应从以下几方面进行分析:一是短视频是否属于版权保护的客体,详细分析版权作品的独创性特征;二是短视频侵权的构成要件应该符合普通民事侵权的“四要件”;三是剖析短视频版权侵权的免责情形。
