垄断协议规制中算法合谋分类研究

Type Study of Algorithm Collusion in Monopoly Agreement Regulation

科学技术发展改变了传统生产经营模式,引起市场力量显著变化,对市场竞争秩序的冲击不可忽视。其中,利用算法实施的合谋行为具有多样化、智能化和隐蔽化特征,往往构成受禁止的垄断协议行为。本文采用分类研究方法全面探讨预设代理型算法合谋、中心辐射型算法合谋及自我达成型算法合谋三类行为的形式特征、规制困境和规制对策。在此基础上,本文提出宜充分考量算法合谋现象的影响,对垄断协议概念进行重新界定或扩大解释,谨慎探讨如何通过立法规制该行为,采取合理技术手段加强监管执法,进一步厘清算法合谋行为规制思路。

The development of science and technology has changed the traditional business mode,causing significant change in market forces.The impact on market competition order cannot be ignored.Among them,the collusive behavior implemented with algorithm has the characteristics of diversification,intelligence and concealment,often constitutes a prohibited monopoly agreement.This paper tries to comprehensively explore the patterns and characteristics,regulatory dilemmas and regulatory measures of three types of behaviors,which are Presupposed Agent Algorithm Collusion,Hub-And-Spoke Algorithm Collusion and Self-Achievement Algorithm Collusion.Therefore,this paper proposes that the effects of algorithm collusion should be taken into consideration,the concept of monopoly agreement should be redefined or reinterpret,careful discussions on legislation measures should be made,and reasonable technical measure should be used in supervision and enforcement.Also,the logic of algorithm collusion regulation should be further clarified.
