基于药理实验数据探讨中药组合物发明的新颖性推定问题

A Probe into the Problem of Presumption of Patent Novelty of TCM Composition Based on Pharmacodynamic Test Data

本文结合审查实践中的具体案情分析中药组合物发明的新颖性推定问题,探讨基于药理学实验数据推定中药组合物发明的新颖性逻辑方式和基本思路。在此基础上,指出对于中药组合物的新颖性推定需要结合中药领域的特点,充分参考现有的评判标准和现有的事实依据进行综合评判。

Based on the specifi c cases in the practice of examination,this paper analyzed the problem of presumption of patent novelty for invention of TCM composition,and discussed the logic and thinking of presumption of invention novelty of TCM composition based on pharmacodynamic test data.On this basis,pointing out that in the process of presumpting the novelty of TCM composition,it is necessary to combine the characteristics of TCM fi eld and make a comprehensive evaluation with full reference to the existing evaluation criteria and factual basis.
