Introduction and Analysis of JPO Retrieval System and Patent Law

日本专利局(JPO)作为世界五大知识产权局之一,其在专利检索、审查标准及程序、质量管理等方面与中国国家知识产权局存在较多制度上的差异。本文重点介绍了JPO的检索系统及相关法条的审查标准,以期在此基础上,取长补短,合理借鉴、吸收、消化和创新外局审查制度,为完善审查政策,提高审查效能提供参考。

As one of the top fi ve intellectual property offi ces in the world,Japan Patent Offi ce(JPO)has many institutional diff erences with CNIPA in terms of patent retrieval,examination standard and quality management.This paper mainly introduces JPO retrieval system and patent law.By analysis the diff erences between JPO and CNIPA,we strive to provide reference for perfecting our patent examination policy and improving our examination effi ciency.
