浅析执行本单位的任务所完成的职务发明创造的判断标准

On Determination of Service Invention-Creation Made by Execution of the Entity Task

如何确定单位任务的范围以及涉案专利与单位任务之间的关联性是判断一项发明创造是否属于执行本单位的任务所完成的职务发明创造的关键。实践中对于上述两个问题的处理有不同的观点,在分析现有观点的基础上,本文认为,界定单位认为的范围时应坚持折中主义原则;而对于关联性的认定,不仅要进行技术方案的对比,还要综合考虑其他在案因素,例如,原单位的研究方向、被告的教育背景及职业经历、所涉技术的先进性等。

The scope of the entity task and the correlation between the disputed patent and the entity task are two key factors for determining whether an invention is a service invention-creation made by execution of entity task.In practice,different opinions are presented on how to deal with the above two problems.On the basis of analyzing previous cases,this article points out that the scope of entity task should be defined under the Eclectic Principle.For the determination of correlation,it is necessary not only to make a technical solution comparison,but also to consider other factors,such as the research direction of the entity,the professional experience and educational background of the defendant,and the advancement of the involved technology.
