摘要
辅警职能定位层面的"警务辅助",辅警与警察关系层面的"权力代理",辅警责任归结层面的"担保责任",共同构成了我国辅警制度基础理论中的"三位一体"架构;"警务辅助"的职能限定是辅警制度建构的基础与前提,"权力代理"的关系界定是辅警制度运行的关键与枢纽,"担保责任"的归责厘定是辅警制度实施的保障与根基;"三位一体"理论架构的确立与应用,利于增进辅警管理的职业化与层级化、辅警履职的明确化与规范化、辅警担责的法治化与常态化。
Police assistance is the function orientation of the auxiliary police,power agency shows the essence of the relationship between the auxiliary police and police,the auxiliary police bear the guarantee liability,all of these together build a trinity structure,which is the basic theory of auxiliary police system in China.The function limit of Police assistance is the foundation and premise of the construction on the auxiliary police system,the relationship definition of power agency is the key and the operation of the auxiliary police system,the determination of guarantee liability is the ensure and foundation implemented of auxiliary police system.The establishment and application of the theory of the trinity framework,which promote the professionalization and stratification of auxiliary police management,enhance confirmation and standardization of auxiliary police’s performance,and strengthening the legalization and normalization of the responsibility of the auxiliary police.
