董仲舒的女性悲悯情怀

Dong Zhongshu’s Compassion for Females

汉代著名儒生董仲舒对女性充满同情。董仲舒的女性悲悯情怀奠基于其阴阳相合及天地之性人为贵的思想。董仲舒认为,百姓是国家的根基,天地之性人为贵。正因为如此,女性也应得到照顾与保护。董仲舒的女性悲悯情怀在司法领域表现在两个方面:一方面,在三正,也即天正、地正和人正所代表的三个月里,对女性罪犯予以宽大处理;第二个方面,在春秋决狱过程中,对女性予以特殊照顾。

Dong Zhongshu,a famous Confucian scholar in the Han Dynasty,shows compassion for females.Such compassion is based on the idea of the harmony of yin and yang and the idea of humans’being respectable among the living things in the world.He holds that common people are the foundation of the country and that humans are respectable among the living things in the world.It is because of this that females should be taken care of and protected.Dong Zhongshu’s compassion for females is manifested in two aspects in the judicial field.On the one hand,female criminals are treated with leniency in the three months that Tianzheng,Dizheng and Renzheng represent respectively,that is,November,December and January of the lunar calendar.On the other hand,female criminals are given special care in the process of penalty judging and prison sentencing according to Spring and Autumn Annals.
