摘要
用法治手段和法治思维规范档案管理具有重要意义,但我国现有档案法律对人事档案的规范只具有宏观的指导性,不具有针对性。人事档案信息保护和利用政策主要是宏观的指导意见,操作性不够强。实现人事档案信息保护和利用的法治化,应以人为本,进一步完善人事档案法律法规,兼顾公权强制性和私权合理性;既做好档案利用服务,又确保档案信息安全;健全法律制度,加强教育培训,提升执法监督,依法改进人事档案信息的保护和利用,更好地发挥档案服务于人才、服务于社会的积极作用。
Using legal means and legal thinking to standardize the management of archives,improve the level of archive management and maintain the personal information security of personnel archives is of great significance to standardize the management of personnel archives,enhance the social credibility of personnel archives,guarantee the orderly flow of talents and promote the stable and orderly development of economy.However,the existing archive law of our country only provides macro guidance and has no pertinence to the regulation of personnel archives which belongs to a special archive classification.The policies of the personnel archive information protection and utilization are mainly macro guiding opinions,which are not strong enough in operability.In order to realize the legalization of the personnel archive information protection and utilization,we should adopt the people-oriented concept,further improve the laws and regulations on personnel archives,and give consideration to both the compulsion of public power and the rationality of private rights;not only do a good job in the archive utilization service,but also ensure the archive information security;improve the legal system,strengthen the education and training,enhance the supervision of law enforcement,improve the protection and utilization of personnel archive information in accordance with the law,and better realize the positive effect of archives in serving talents and society.
