The Type Evolution of the Scope of Administrative Mediation Disputes

行政调解是多元化解纠纷体系中的关键一环,明确其调解的纠纷类型范围对分流诉讼解纷压力、实质解决纠纷有着重要意义。立足于现行法律法规对行政调解纠纷范围的类型划定及部分法律授权的笼统性的现实样态,行政调解纠纷范围的类型嬗变,应在完善相应立法的基础上,根据纠纷类型对行政调解的范围作进一步拓宽或限缩的调整,包括调解行政纠纷的范围拓展、调解民事纠纷的范围限缩与明确及行政调解劳动纠纷的引入等方面,以顺应社会需求,发挥其化解纠纷的主导性功能并兼顾其专业化走向。

Administrative mediation,as a key link in the system of diversified dispute resolution,is of great significance to clarify the scope of dispute type of mediation litigation,and to resolve disputes in substance. Based on the current law s and regulations on the type of administrative mediation disputes,the general nature of some legal authorization and the type transmutation of administrative mediation dispute scope,the scope of administrative mediation adjustment should be further broadened or limited according to the type of disputes on the basis of perfecting the corresponding legislation,,including the expansion of the scope of mediation administrative disputes,the restriction and clarification of the scope of mediating civil disputes as well as the introduction of administrative mediation labor disputes,so as to meet the needs of society and play its leading role of resolving disputes while taking into account its specialization trend.
