高校的教育惩戒不单纯在于对违反学业标准和教学秩序的学生进行惩处,还包含了通过惩戒实现教育教学效果的目的。因此,在高校教育惩戒过程中必须要强调学生参与。学生参与教育惩戒过程既是高校民主治理的基本需求,也是实现程序正义和保障学生权益的重要途径。高校教育惩戒中的学生参与权主要包括知情权、听证权、校内团结权等权利,而学生参与高校教育惩戒的路径则包含了事前参与、事中参与和事后参与三个方面。

The aims of educational discipline of colleges and universities lie not only in punishing students who violate schoolwork standards or teaching order,but in meeting educational demands through punishments.Therefore,students’participation should be attached much importance during the educational discipline,which is not only the prerequisite for democratic governance by colleges and universities,but an important means for ensuring due process and students’rights and interests during the practice.The principles of students’participation in educational discipline are reflected in their rights to know,to hear and to unite on campus.Ways for students to participate in educational discipline of colleges and universities include participation in advance,in the course,and afterwards.
