细谈“司法制造争议”——以张某网搜公民个人信息出卖案为例

纷繁复杂的社会决定了创造一个完全没有争议、没有问题的法治社会只是一种柏拉图式幻想,有问题并不可怕,可怕的是这些问题已经肆意疯长,而我们的法律执行者却仍熟视无睹,或安然自得。“司法制造争议”不是个案,而是整个司法环境普通存在的现象。它的危害可能不像生死重症一样要人性命,但是它却如同付骨之疽,无时无刻吸食破坏着国家、社会、人民的最纯正的法治期盼。而欲解决这个问题,应当从源头上清理故旧残缺的司法观念,从罪刑法定的根本整顿立法、司法以及执法,这是恪守刑事法治的应有之意。
