摘要 传统法学教学方式束缚法学本科教育发展,在法学本科生中开展研究性学习是当前法学教育改革的需要。由于教学制度环境、教育理念、应试教育体制和司法考试导向性等因素,导致研究性学习理念在法学专业本科教学中的实施效果不甚理想。反思当前法律案例教学法、模拟法庭教学法的不足,通过改进课程体系与教学方式、优化考核评价机制、保证实务课程质量和正视法律职业资格考试导向作用等措施,探索切实可行的研究性学习理念实施路径。 Traditional teaching methods of law restrict the development of undergraduate education of law,and carrying out research-based learning among undergraduates of law is the need of current law education reform.Due to such factors as teaching system environment,educational concept,examination-oriented education system and judicial examination orientation,the implementation effect of research-oriented studying concept in undergraduate teaching of law is not ideal.We should reflect on the shortcomings of the current legal case teaching method and moot court teaching method,and explore feasible ways to implement the research-oriented studying concept by improving the curriculum system and teaching methods,optimizing the examination and evaluation mechanism,guaranteeing the quality of practical courses and facing the guiding role of legal vocational qualification examination.
