摘要
工伤认定是一项政策性极强的工作,精心精准做好新冠肺炎的工伤认定,对于全面打赢防控新冠肺炎这场阻击战意义重大。本文依据《工伤保险条例》、国家有关部门新出台的关于因履职感染新冠肺炎相关人员保障问题的文件、社会保险法等,对劳动者感染新冠肺炎引发的劳动关系、社会保险等问题,从工伤认定与否、用人单位参保与否进行政策解析和待遇差别比较,以期为切实做好抗击新冠肺炎疫情中的工伤认定工作提供参考。
Identifi cation of industrial injury is a work with strong policy nature.It is of great signifi cance to carefully and accurately identify industrial injury in COVID-19.According to the regulationsnewly issued documents and the law,this paper analyzes the labor relations and social insurance caused by the workers'infection with COVID-19,and compares the policy and treatment diff erence between whether it is recognized as work injury and whether the employers participate in the insurance.
