共商共建共享原则:国际法基本原则的新发展

The Principles of Extensive Consultation,Joint Contribution and Shared Benefits:the New Development of Fundamental Principles of International Law

共商共建共享原则逐步获得了国际社会的普遍认可,具有普遍约束力且能适用于国际法各个领域,因而具备了现代国际法基本原则的主要特征。共商共建共享原则不但为国际法基本原则增添了新的内容,而且深化了诸如国家主权平等原则、国际合作原则、和平解决国际争端原则等国际法基本原则的内涵。共商共建共享原则是对和平共处五项原则的扬弃,是新时代中国国际法学的重要理论贡献,也是人类命运共同体思想的真实写照和具体化。

The principles of extensive consultation,joint contribution and shared benefits have gradually recognized by international community,which are universally legal binding and can be generally applied in various branches of international law,thus they possessed main characteristics of fundamental principles of modern international law.The principles of extensive consultation,joint contribution and shared benefits not merely added new content to fundamental principles of international law,but also deepened the meaning of fundamental principles of international law such as the principle of sovereign equality of States,the principle of international co-operation and the principle of peaceful settlement of international disputes,etc.Furthermore,the principles of extensive consultation,joint contribution and shared benefits are subdue of the Five Principles of Peaceful Co-existence and made great theoretical contributions to Chinese international jurisprudence for a New Era.
