公共图书馆法定呈缴之立法刍议

Opinion on the Legislation of Public Library’s Legal Submission

当前我国缺乏统一的公共图书馆法定呈缴立法,现有的法定呈缴制度中仍然存在呈缴本范围不明确、呈缴义务主体和接受主体设定不规范、呈缴条件设定不统一且呈缴规范有待完善、法律责任规定不合理等问题。因此,我国应立足于公共图书馆法定呈缴制度的现状,借鉴国外图书馆法定呈缴的立法模式和经验,由国务院制定统一的《公共图书馆法定呈缴本缴送管理条例》,规范公共图书馆的法定呈缴活动,保障公民的基本文化权益。

At present,China does not have a unified legal filing system for public libraries.The existing statutory payment system still has unclear definition of the scope of the submission,the principal and the recipient of the submission obligation are not standardized,the conditions for submission are not unified and the submission specifications need to be improved,and unreasonable legal liability.Therefore,it is necessary for China to be based on the status quo of the legal submission system for public libraries and and learn from the legislative model and experience of the legal submission system of the foreign library.The State Council should formulate unified "Statutory Submission Law for Public Libraries",regulate the legal submission activities of the public library,and protect the basic cultural rights and interests of citizens.
