摘要 借名买房行为由借名人、出名人的借名协议与出名人、交易相对人的房屋买卖合同所组成。借名协议的效力会因购买房屋的性质不同而有所不同。在当事人内部,以借名当事人的意思自治为主,依据借名协议的约定以及相关举证对房屋归属予以认定。在借名关系外部,涉及交易第三人的借名行为法律效果须考虑第三人是否为善意以及争议房屋的所有权是否已经转移至第三人名下等因素,以判断借名人的债权是否更值得优先保护;涉及申请执行人时,作为借名人的案外人享有的债权不足以排除强制执行。出名人无法履行义务时,借名人可主张违约责任以求救济。 The behaviour of purchasing estate on a borrowed name is composed of agreements between the parties to the behaviour and a contract for the house sale.The validity of the agreements will vary depending on the nature of the house.Within the parties,party autonomy has priority.The ownership of the house shall be determined according to the borrowing agreement and the relevant proof.When concerned the third party in transaction,the legal effect of the behaviour is related to the good faith of the third party and the transformation of the ownership of the house.When concerned the execution applicant,the borrower's rights can not exclude coercive execution.The borrower can claim for liability for breach of contract when the party who's name is borrowed fails to fulfil the agreement.
