区域视角下“法治浙江”的理路、阻却与对策

The Logical Thinking, Hindrances of “Zhejiang Governed by Law” from a Regional Perspective and Its Countermeasures

在建设中国特色法治社会的背景下,由于各地区经济、文化、地理等方面存有差异,因此,坚持区域法治建设无疑是必然之举。自1996年浙江省委提出“依法治省”后,截止目前,已然走出一条极具特色的地方法治建设之路。一方面,“法治浙江”在建设过程之中注重与社会民情相结合,不断突破、创新原有的地方治理方式;另一方面,受现代化转型影响,“法治浙江”模式也出现不少新的阻却,主要表现为:地方立法质量略有欠缺、个别权力部门法治建设低效、县级地域法律人才稀缺。基于“法治浙江”建设的现实需要,从审查、监督、共享三方面入手,构建地方立法审查制度,利用多方力量监督公权力行使,建立区域人才共享机制。如此,进一步驱动“法治浙江”模式的再完善。

Under the background of building the rule of law with Chinese characteristics,it is inevitable to adhere to the construction of regional rule of law because of the disparities existing in the aspects of economy,culture and geography among different regions.Since the Zhejiang Provincial Party Committee put forward the concept of“Governing the Province according to Law”in 1996,the province has so far embarked on a unique road to the construction of local rule of law.On the one hand,the construction of“Zhejiang Governed by Law”focuses on considering specific social and public conditions,and constantly breaking through and innovating the original ways of local governance in the process of construction.On the other hand,many new hindrances appear in the model of“Zhejiang Governed by Law”influenced by the transformation of modernization.The hindrances exhibit themselves as follows:the slightly low quality of local legislation,the inefficiency of the construction in certain power departments and a shortage of regional legal talents at the county level.Based on the practical demands in the construction of“Zhejiang Governed by Law”,it is advisable to start from the three aspects of examination,supervision and sharing for the purpose of constructing a local legislative review system,taking advantage of various forces to supervise the exercise of public power,and establishing a regional talent sharing mechanism.In this way,the perfection of the model of“Zhejiang Governed by Law”can be further conducted.
