单个游戏画面构成美术作品,动态视频画面构成视听作品。网络游戏版权属于游戏开发者,网络游戏画面版权属于网络游戏主播或者游戏玩家。网络游戏直播行为必须得到网络游戏开发者的许可,否则构成版权侵权行为,游戏主播不得以合理使用为由抗辩。
