Starting a New Journey of Modern and Law-based Governance of China

从法治理论角度来看,党的十九届四中全会《决定》具有以下显著特征和重大意义:开启国家治理新征程,是推进国家治理现代化法治化的政治宣言、行动纲领;彰显"中国之治"本质特征,是坚持党的领导、人民当家作主、依法治国有机统一的重大制度安排;描绘"制度之治"宏图伟略,为党和国家长治久安提供一整套更完备更稳定更管用的制度体系;体现"宪法之治"国家意志,宪法是国家各项制度和法律法规的总依据,坚持和完善中国特色社会主义制度,必须健全保证宪法全面实施的体制机制;推进"法治之治"骨干工程,法治体系是中国特色社会主义制度的法律表现形式,推进国家治理现代化必须加快建设法治体系。

From the perspective of the theory of rule of law, the Decision of the Fourth Plenary Session of the 19 th CPC Central Committee has remarkable characteristics and great significance. First, it starts a new journey of national governance and is a political declaration and action program for modernizing national governance and making it law-based;second, it highlights the essential feature of the "governance of China", and is a major institutional arrangement that adheres to the organic unity of the Party’s leadership, the people’s position as masters of the country and rule of law;third, it describes the grand plan of "governance of institution" and provides a set of more complete, stable and effective system for the long-term stability of the Party and the state;fourth, it reflects the national will of the "governance of the Constitution", which is the general basis of all kinds of national systems, and laws and regulations. To adhere to and improve the socialist system with Chinese characteristics, we must improve the system and mechanism for ensuring the full implementation of the Constitution;fifth, it advances the key program of the "governance of the rule of law". The legal system is the legal manifestation of the socialist system with Chinese characteristics. To modernize the governance of China, we must speed up the improvement of the legal system.
