摘要
"治理"一词在近年来广泛运用。从党的十八届三中全会所提出的"国家治理现代化"所表述的内容来看,法治与国家治理体系现代化所要求的治理能力有着内涵上的关联和外延上的契合。应从宏观理论层面、中观制度问题和微观实践现象的阐明,来对中国语境下的"国家治理现代化"进行正确理解,从而厘清法治在其中的定位与作用。
The term "governance" has been widely used in recent years. From the statement of "modernize the governance of China" made in the Third Plenary Session of the 18th CPC Central Committee, the rule of law and the governance capacity required by the modernization of China’s system of governance agree with each other in connotation and denotation. This paper advocates elaborating the macro theory, the meso institutional problems and the micro practice and correctly understanding "modernize the governance of China" in the Chinese context, so as to clarify the position and role of the rule of law in it.
