论涉外劳动关系认定的法律适用

摘要 涉外劳动关系的主体能力、主体之间的关系从属性、作为客体的劳动行为等因素促使涉外劳动关系的认定成为独立问题,也是涉外劳动合同等后续纠纷的先决问题。它不同于选择适用劳动法抑或民法的识别问题,也不完全是强制性规定问题。为了认定劳动关系的效力,涉外劳动关系认定应适用场所支配行为的原则。为了实现尽量认定当事人之间存在劳动关系的目标,可以在主要适用行为地法的前提下,有条件地选择适用属人法和法院地法。 In foreign-related labor relations,the subjective ability,the relations between subjects,and the object make foreign-related labor relations become independent issues.It can be a preliminary question for the application of foreign labor contract law and other subsequent questions.It is different from the choice of the application of labor law or civil law on identification,and it is not a mandatory issue.The principal to the applicable law is locus regit actum,because the effect of labor relations determines lex loci actus.To make the labor relations possible to be affirmed,the relations between the subject and the subject determines that lex personalis and lex fori can be supplemented and applied.
