The Functions and the Major Contents of Basic Health Service and Health Promotion Law

2019年12月28日,《基本医疗卫生与健康促进法》经十三届全国人大常委会第十五次会议表决通过,并将于2020年6月1日正式施行。这是我国卫生健康领域首部基础性、综合性的法律,对于深化我国医药卫生体制改革和卫生与健康事业发展将起到规范、整和与引领作用,具有里程碑的意义,是实施健康中国战略的坚实法律保障。对该部法律的定位与功能、主要内容与需要建立的相关机制制度进行了整体性梳理、分析和探讨,对于该部法律的实施和亟需启动的相应立法和制度建构提出了建议。

The 15 th session of the Standing Committee of the 13 th National People’s Congress enacted the Basic Health Service and Health Promotion Law on December 28,2019.This is the first foundational and comprehensive law in the health sector in China.With its normative,integrative and guiding functions,it will further deepen the reform of China’s health system and promote its health undertakings.It is a milestone and a reliable legal guarantee for the implementation of the Healthy China Initiative.This paper illustrates,analyzes and discusses its status and functions,its major contents and the relevant mechanisms and systems expected by this law,and proposed suggestions for badly needed corresponding legislations and institutional construction.
