我国电子处方流转外配的法律风险及其对策研究

Research on legal risks and countermeasures of the circulation and distribution of electronic prescriptions in China

目的:分析当前我国电子处方在流转外配过程中的现实困境与法律风险并提出对策建议。方法:运用文献研究法与比较研究法分析电子处方流转外配现状。结果:目前,我国电子处方面临真实性、签名留样可靠性认定困难,医疗机构对处方外配有限制,医保对处方流转外配支付限制,退回、修改及管控存在漏洞,面临着无明确法律地位、缺乏科学流转机制、处方外配缺乏有效监管及追责体系等法律风险。结论:应尽快出台我国电子处方专门性立法,加快建立电子处方流转平台建设,实现电子处方与医保支付的有效对接,加强对电子处方流转外配的监管。

objective:Analyzing the current difficulties and legal risks of electronic prescription in the process of circulation and distribution,and puts forward countermeasures and suggestions.Methods:Using the method of literature research and comparative research to analyzes the current situation of the circulation and distribution of electronic prescription.Results:At present,China’s electronic prescriptions are facing difficulties in authenticity and reliability identification of signature retention samples,medical institutions have restrictions on out of prescription allocation,medical insurance has restrictions on the payment of prescription circulation and out of prescription allocation,and there are loopholes in return,modification and control.Facing the legal risks of no clear legal status,no systematic circulation mechanism,and no effective supervision and accountability system for circulation outsourcing.Conclusion:Promulgate special legislation of electronic prescription in China as soon as possible,Speed up the establishment of electronic prescription circulation platform,realize the effective connection between electronic prescription and medical insurance payment,and strengthen the supervision of the circulation and distribution of electronic prescription.
