户籍政策中公民平等权的宪法思考——以上海大学生落户新政为例

Constitutional Thinking on Citizens’ Equality in the Household Registration Policy——Taking the New Policy for University Students’ Household Settling in Shanghai as An Example

平等权作为一项基本人权,也是我国宪法所规定的公民基本权利之一。平等权的价值是国家权力正当化的基础,平等的实质在于反对歧视以及在严格审查后的合理对待。以上海市大学生落户新政涉及的宪法平等权的问题为例,探究平等权在当下我国宪法语境中的地位与表现,从合理的差别待遇理论入手,可以解答类似上海大学生落户新政中涉及的宪法平等权问题。

As a basic human right,the right of equality is one of the basic rights for citizens as stipulated in our constitution.The value of equality rights is the basis for the normalization of state power.The essence of equality lies in anti-discrimination and reasonable treatment after strict examination.This paper discusses the issue of the constitutional equality right in the new policy of college students’household settling in Shanghai,explores the status and performance of equality right in the context of the current constitution of China,and puts forward that the rational theory of differential treatment can answer the issue of the constitutional equality right involved in the new household policy of Shanghai university students.
