新时代自主创新背景下中医药文化传承与知识产权保护路径探析

Discussion on the path of traditional Chinese medicine cultural heritage and intellectual property protection under the background of independent innovation in the new era

新中国成立70年来,随着《中华人民共和国中医药法》的颁布,“健康中国”概念的提出,中医药迎来前所未有的发展机遇。传承和发展中医药目前已成为党和国家的重要方针战略,而中医药文化传承及中医药知识产权保护则是其中的重要核心环节。两者之间相互促进、相辅相成。本文基于新时代自主创新背景下,试图对中医药文化传承与中医药知识产权保护路径进行探析,并提出对策建议。

Since the founding of people′s Republic of China 70 years ago,with the promulgation of The Chinese Medicine Law of the People′s Republic of China,the concept of“healthy China”has been put forward,and traditional Chinese medicine has ushered in unprecedented opportunities for development.The inheritance and development of traditional Chinese medicine has become an important policy and strategy of the party and the state,and the inheritance of traditional Chinese medicine culture and the protection of intellectual property rights of traditional Chinese medicine are the key links.They promote each other and complement each other.Based on the background of independent innovation in the new era,this paper attempts to explore the path of traditional Chinese medicine cultural heritage and intellectual property protection of traditional Chinese medicine,and puts forward countermeasures and suggestions.
