地方高校法学专业实施诊所法律教育路径研究

Ways to Carry out Clinical Legal Education at Law Schools in Local Colleges and Universities

迄今为止经历了50多年发展历程的诊所法律教育在提升法学学生实务技能方面发挥着越来越重要的作用,在国内高校中不断得到普及和推广,尤其在各地方高校的法学专业建设中,诊所法律教育的重要性日益凸显。以地方高校法学专业教育为着眼点,阐释诊所法律教育对于地方高校法学教育的特殊意义,进而分析地方高校法学专业实施诊所法律教育的资金条件、师资条件、学生条件以及社会条件,最后从诊所法律教育的运作模式选择、经费保障制度和运行管理机制三个方面探索地方高校法学专业实施诊所法律教育的路径。

Clinical legal education, which has experienced more than 50 years of development, has been playing an increasingly important role in improving the practical skills of law students. It has been popularized and promoted in local colleges and universities,especially in the construction of law majors. The importance of clinical legal education is becoming increasingly prominent. Focusing on the law education of local colleges and universities, the present paper explains the special significance of clinical law education for local colleges and universities, then analyzes the funding conditions, teacher qualifications, student conditions, and social conditions of local law majors, and finally explores the path of implementing clinical legal education in local colleges and universities from the perspectives of the choice of education operation mode, funding guarantee system and operation management mechanism.
