侵财型虚假诉讼是诉讼诈骗与虚假诉讼的交叉部分,因立法和司法解释规定而具有了相对明确的罪状特征和司法适用准则,但在刑法定性问题上面临与诉讼诈骗相似的理论困境:如何从"被骗"和"自愿处分"两大行为构成要素论证该类行为与诈骗罪具有形式符合性。以法官角色为视角,是虚假诉讼犯罪的特殊性使然,也为解决上述困境提供答案:被骗者是法官;法院具有财产处分权、居于财产处分人地位。这两大要素也是三角关系得以开展的关键环节,对于罪与罪的区分具有重要意义。在肯定法官裁判行为合法性的同时,要警惕权力被滥用。

The false litigation against property is the intersection of litigation fraud and false litigation,it obtained relatively clear criminal characteristics and judicial application criteria because of legislative and judicial interpretations,but it faces a theoretical dilemma similar to litigation fraud on the issue of criminal nature: how to demonstrate that this type of behavior is in conformity with fraud from two elements of"being cheated"and"voluntary disposition". The Perspective of the role of judges is because of the particularity of false litigation crimes,and it provides answers to the above dilemma: the deceived person is the judge;the court has the power to dispose of proterty and is the one to dispose of property. These two major elements are also the key links in the development of a triangle relationship,and is of great significance for the distinction between crimes. While affirming the legitimacy of judges’ judgements,be wary of abuse of power.
