正当防卫制度在司法实务中的法律适用效果不尽如人意,与立法不完善有一定关系。刑法规范需要高度抽象,立法者也需要为司法“留白”,因而对正当防卫制度的完善不应当仅着眼于防卫要件的细化和防卫情境的类型化,更应当采取适当的刑法理论立场,重构正当防卫制度,从而为正当防卫制度的司法实践提供充分的规范前提与合理的刑事司法立场,使刑事司法活动获得良好的社会效果。

,but the legislators also have to leave room for the judicial discretion.So the perfection of legitimate defense system should not only focus on the refinement of defense elements and the typification of defense situations,but also adopt the appropriate theoretical position of criminal law and the reconstruction of the system of legitimate defense.Only in this way the sufficient normative premise and reasonable criminal judicial stand for judicial practice of legitimate defense system can be provided,and the positive social effects can be obtained.
