他律型方法的立法运用与规范设置——以备案审查制度为例

Legislative Application and Normative Setting of Heteronomy Method——Take the Filing Review System as an Example

他律型立法方法是立法机关审查地方立法的方法,是加强备案审查的结果,旨在维护我国法制统一。他律型立法方法在立法实践中针对不同的审查内容,分别设置了合宪性审查、合法性审查和合法规性审查三种审查模式。这三种审查模式共同构建起我国特色的复合审查体制。他律型立法方法的规范适用,应当遵循职权法定的规则,为不同他律主体提供明确的审查范围,同时也应当按照程序法定规则的指引,要求他律主体依法履行备案审查,实现法律体系内部的稳定、统一。

Aiming at maintaining the unification of the legal system in our country,the method of heteronomy legislation is the method of examining local legislation by other legislatures,which is the result of strengthening the examination of filing.In the practice of legislation,the legislative method of heteronomy has set up three review modes,namely,constitutionality review,legality review and legality and regularity review,for different review contents.These three modes jointly construct a compound review system with Chinese characteristics.The normative application of the legislative method of heteronomy should follow the rules of statutory authorities,provide clear scope of examination for different subjects of heteronomy,and at the same time,according to the guidance of the statutory rules of procedure,require the subjects of heteronomy to perform the examination of filing according to law,so as to realize the stability and unity within the legal system.
