第三方平台固定电子数据的效力评估及其评价指标体系构建--以北京互联网法院“天平链”为例

Effectiveness Evaluation of Fixed Electronic Data and Construction of Evaluation Index System in Third-party Platforms--Taking the Beijing Internet Court’s“Legal Balance Chain”as an Example

随着电子数据这种证据形式在纠纷中的作用越来越重要,如何审查判断电子数据是否具有证据能力、是否具有证明力尤为重要。笔者参与北京互联网法院天平链应用接入管理与技术规范研制,通过参考最高法相关司法解释、电子数据司法鉴定相关标准,制定了一套效力评估流程和评价指标体系。

As the role of electronic data as a form of evidence in disputes becomes more and more important,how to review and judge whether electronic data has credibility and whether it has probative value is particularly important.Through the access management and technical specification development for the application of Beijing Internet Court’Legal Balance Chain,this paper formulates a set of effectiveness evaluation processes and evaluation index systems by referring to the relevant judicial interpretations of the Supreme Law and relevant standards for electronic data judicial expertise.
