摘要
为了制止网络游戏规则的抄袭行为,游戏开发者试图通过著作权法对网络游戏规则进行保护,但这一做法不具有可行性。网络游戏规则不是现行著作权法上所规定的作品类型,不属于著作权法上的作品。网络游戏规则具有技术功能特征,不属于著作权客体范围。如果将网络游戏规则纳入著作权客体范围,将带来游戏开发成本、权利管理成本的增加以及寻租行为,不利于激励网络游戏领域的创新。
In order to fight against the phenomenon that the rules of online games to copied,the game developers try to protect the rules of online games through copyright law,but this approach is not feasible. Online game rules are not protected by copyright law,because online game rules are not one of the work types stipulated by the current copyright law. Technical functionality is the characteristic of online game rules,which doesn’t belong to the scope of copyright objects. If online games rules are protected by copyright law,the increase of gamedevelop cost,right-manage cost and rent-seeking behavior will happen,which is not conducive to the innovation in the field of online games.
