关于档案权责的立法思考

On the Legislation of Relationship of Archives Rights and Responsibilities

文章从档案权利和责任的角度对现行档案法和2019年档案法修订草案的内容进行了分析,并参考了其他国家在该领域的法律规定,对推进档案工作责任制、细化档案违法惩处措施、确保各类主体的档案利用权利以及厘清电子档案收集和管理中的权责关系提出了个人见解。

This paper analyzes the contents of the current archives law and the draft amendments to the archives law of 2019 from the perspective of archives rights and responsibilities,and makes refer⁃ence to other countries'legal provisions in this field,then gives some personal suggestions on how to pro⁃mote the responsibility system of archival work,how to specify the punishment measures for illegal archi⁃val work,how to ensure the utilization rights of vari⁃ous subjects,and how to clarify the relationship of power and responsibility in the collection and man⁃agement of electronic archives.
