On the Patternization of Identification Standards for Administrative Contracts

行政协议的有效识别是行政审判实务中亟待解决的一个问题,统一的识别标准是审判规范化的保障。通过案例分析的方式,提炼出行政协议与民事合同相区别的要素,即行政协议识别的"公因式";结合逻辑推论与理论分析,将主体、权利义务与目标三项"公因式"进行整合,对识别标准展开模式化研究,试图探寻本土化的、实用的行政协议识别模式,并对其进行验证。"主体+目标"模式与"主体+权利义务"模式,二者择一,构成了行政协议的有效识别模式。

The effective identification of administrative contracts is an urgent problem to be solved in administrative trials.A unified mode for this identification is the guarantee of the standardization of trials.This paper abstracts the elements that distinguish administrative contracts and civil contracts through case analysis.The elements that distinguish contracts are the"common factors"for administrative contract identification.While integrating the subject,the rights and obligations,and the aim,which are the three main"common factors",a localized and practical mode for administrative contract identification has been found through logical inference and theoretical analysis,and then verifies it."Subject + Aim"mode and"Subject +Rights and Obligations"mode constitute an effective mode for administrative contract identification.
